India’s competition watchdog, the Competition Commission of India, has dismissed a complaint that accused two of the country’s largest airlines, IndiGo and Air India, of abusing their market dominance in the domestic aviation sector. The regulator concluded that there was no prima facie evidence of anti-competitive behaviour or violations of the Competition Act.
The complaint alleged that the airlines had imposed unfair cancellation charges and used their strong market presence to disadvantage consumers. It also sought an investigation into whether the carriers were exploiting their dominant positions in the market for domestic air passenger transport services. However, after reviewing the matter, the regulator found no proof that the airlines had engaged in practices that restricted competition or harmed consumers.
According to the commission’s findings, airline policies regarding cancellations and refunds were clearly disclosed to passengers and applied in a transparent manner. The regulator noted that refund mechanisms already exist and that the terms governing cancellations are communicated to customers during the ticket booking process. As a result, the commission determined that the complaint did not establish a case strong enough to warrant a detailed investigation.
The complainant had also requested that the regulator link this case with another matter related to flight cancellations. The commission declined this request, stating that the issues raised in the two cases were different and therefore did not justify a joint investigation.
IndiGo currently holds the largest share of India’s domestic aviation market, while Air India has been steadily expanding its operations after returning to private ownership under the Tata Group. Despite their significant presence in the industry, the competition regulator said the available evidence did not indicate abuse of dominance or any practice that could distort market competition.
The decision brings clarity to concerns that had been raised about competition within India’s rapidly growing aviation sector. With passenger traffic increasing and airlines expanding fleets and routes, regulatory oversight continues to play an important role in ensuring fair competition while protecting consumer interests.
